Hi,
I filed my 485 on July 5, 2007 at NSC and got my receipt number yesterday. I sent my wifes 485/765/131 on July 24, 2007 to NSC. She is on H4 currently. TOday i got my wifes receipt numbers for all 3. But to my surprise the receipt numbers were given by TSC instead of NSC.
FYI my 140 is pending with NSC.
I am just wondering if this will be a problem? Any one had been through similar situation?

One of my friend is ready to apply for 485. He is all set.
The problem is he got recently married and his wife's passport and other details are not yet ready and she is still in India.
Can he still submit his 485 for his wife?

Hello everybody,
First of all I must appologize because I mentioned this in the forum before but that was a different question that I asked.
My wife's Labor lists a 4 year degree with a BS in Mechanical Engineering as a requirement.
We filed I-140 with her old H1B evaluation which says she has a 4 year degree in Civil Engineering (stupid me :mad: ).
I found another evaluator who looked closely and gave us an evaluation for BS in Mechanical Engineering because her degree is way closer to the Mechanical than it is to the Civil Eng.
Will USCIS reject this I-140 on the spot based on the fact that she doesn't meet the requirements or issue an RFE ? If they issue an RFE and we send the Mechanical Eng. evaluation, will the fact that we filed first with the Civil Eng evaluation cause any problems ? Are we assuming the worst and is not such a big deal ??
She worked on H1B for 7 years as a Mech Eng and this is NOT a labour substitution.

What is unemployment wage report? I read that many visa seekers were asked for this.
Also, they were asked for a notarized list of all the employees with their job title, salary and immigration status. Wow now to get salary information for everyone is breach of privacy.

Irrespective of I-140, you may add your dependents names during 485 filing stage if you date is current.

Hi,
Have a question on EAD/H1b. I am joining a new company using AC21 and EAD. Lets say after few months if INS denies my GC application then will I be able to transfer my h1b. Basically I got the info that I can re-capture my unused period of H1b out of 6 years. Is that true ?

but this serge in processing more Citizenship cases will indirectly slow down 485 approvals due to lack of staff and may result in wastage of visas again for FY 2008.

I used Adobe Acrobat Professional, but it did not fill up the rest of pages.
Do you suggest me to fill out all 4 pages with my info, and then download another G-325A, and fill out with my wife's info?
You just need to fill up the first page & the rest 3 pages would be automatically filled. That's how we did, you can still check against this.

� Filed I-140 & I-485 concurrently with a PD of Nov 2007 (Original Labor) - I-140 Approved and I-485 Pending

it is my understanding that she just needs your H1 approval notice, employment letter, your pay stubs etc. I don't think she even needs her H4 approval notice for her H4 stamping. I am very sure that only your H1 related documents are needed(she needs your original H1 approval)-please check with your lawyer

My current visa status is H4. As i cannot work on this visa, I am interested in doing an Unpaid Internship. Please clarify whether I can do so on an H4 visa.
I'm trying to secure the internship in a nonprofit organisation. Will there be an exception for them, in case it's not allowed otherwise?

AFAIK, you can do volunteer work without restrictions, provided this truly is a volunteer work; i.e., there is no employer-employee relationship, and you are not working in anticipation that you will be hired in near future based on your current work.
Maybe a good test is, if the nonprofit organization requires your SSN before they would allow you to work, then you may not do that work on H4.

It's very painful to deal with these guys at times.
I also tried asking a finance broker about this and never heard back...
Have you tried apporaching another bank or some broker ?
(I was intrested to know if the can do a intrest only loan for 125% of current value...I would think no.....but perhaps no one has all the details ironed out yet)
Given a Chance will never deal with WF.. Horrible customer support.. and have bunch of jokers working for them..

I am currently employed by a large US-based multinational firm on an H-1B visa. My 6 year limit on H1 expires on Nov 27, 2011.
My employer filed Labor Certification for my employment-based Green Card (EB2) over a year ago (on March 1st, 2010).
Since it has been more than a year since Labor has been filed, I am assuming my employer can file for a 1-year extension to my H-1B visa 6 months before it expires (that is on June 27th, 2011). Also, in the meantime, if my Labor and subsequent I-140 are approved, I am assuming my employer can file for 3-year extension to my H-1B.
Question 1: Are these assumptions above correct?
Question 2: Can I quit my job and join another firm after the 1 or 3 year extension is granted? That is will another employer be able to file an H1 petition on my behalf for the extended H1 period (that is beyond 6 years) - even though the extension was granted because of a Labor Certification filed by the previous employer?
I plan to get married to an American Citizen in September. Once I get married, I will obviously file for a marriage-based green card.
Question 3: Given the above, can I quit my job and join another firm now (before my H1 extension is filed)? What are my risks?
If I do stay with my current employer - once I get married, I am assuming that I can file for my marriage based green card (form I-130) and adjustment of status (I-485) concurrently.
