Hello everybody,
First of all I must appologize because I mentioned this in the forum before but that was a different question that I asked.

My wife's Labor lists a 4 year degree with a BS in Mechanical Engineering as a requirement.
We filed I-140 with her old H1B evaluation which says she has a 4 year degree in Civil Engineering (stupid me :mad: ).
I found another evaluator who looked closely and gave us an evaluation for BS in Mechanical Engineering because her degree is way closer to the Mechanical than it is to the Civil Eng.

Will USCIS reject this I-140 on the spot based on the fact that she doesn't meet the requirements or issue an RFE ? If they issue an RFE and we send the Mechanical Eng. evaluation, will the fact that we filed first with the Civil Eng evaluation cause any problems ? Are we assuming the worst and is not such a big deal ??

She worked on H1B for 7 years as a Mech Eng and this is NOT a labour substitution.

Hi Attorneys,

Recently I have filed my H1B petition . However due to some emergency I need to quit my current organisation (Company A) who has sponsored the H1B . My questions are :

1. Would there be any adverse effect if in future Company B files H1B for me ?
2. What generally happens if I file H1B and am not able to attend the interview ?
3. Is there any way Company A can revoke the H1B petition after I resign before H1B interview ?

Would appreciate a quick a reply .

1. There shouldn't be any negative consequences if you change from one H-1B employer to another. People do this all the time.

2. What "interview" do you refer to? If you mean a visa interview at the consulate, you should cancel if you cannot attend.

3. Company A can and should withdraw the H-1B petition once you leave the company. This should not affect you getting new H-1B status, assuming there is no major gap between leaving Company A and Company B filing the new petition.

I applied for the visa lottery while my EB3 I-485 was pending and while waiting for the priority date to be current. I won the lottery and got my green card and the two are COMPLETELY UNRELATED. Good luck with the visa lottery, for me, it saved my sanity!

Can an eb3 with pendding I-40 apply for visa lottery? would that effect the current i-485 application if visa lottery not won? will it cause to the refusal of the I-485?

Please do not rely on Indian Media for immigration news.

They have covered their bases by putting "May" in the headline. "May" increase visas.

There is already a discussion that happened about this on another thread. Please search the forums for the article before starting a new thread.

And for heaven's sake, please dont look for immigration related news in Indian Newspapers. They dont know that congress has two chambers : House and Senate. And they dont know the common basics of legislative process in USA.

I am new to this thread. I have a bachelor degree in Applied Science in IT and got it in about 1 and half years because I got an points exemption from my advance diploma. I also have 7 years of IT working experience and currently hold a H1B1 visa. H1B1 and H1B are not the same thing. The question is can I apply for my GC in eb2 category?

"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

I entered US with a tourist visa in California. Months later, I got married to a US citizen in Austin,Texas. Me and my husband were apprehensive at first to get an immigration lawyer to process my visa but we realized the process of obtaining a visa was not as straight forward as we thought.

We have since decided to hire a lawyer and have met with two attorneys so far. The process is frustrating because of the requirement to pay a consultation fee; we schedule an appointment, meet, and find out that the cost of hiring the lawyer is far greater than what we can afford.

My question is: does anyone know of a good lawyer who charges a reasonable flat fee? $1000 - $1500?
