My wife filed for her I-140 on 7th July 2006, I asked the lawyer for the receipt on 20th July, Instead I got the I-140 APPROVAL on 29th July. I read it twice to confirm it was the approval notice not the receipt:)

You can always use your own attorney for advice, not related to employer. I use usavisanow.com. Immigration Law Office of Maritza Diaz, PC. (http://usavisanow.com/) guys. Charges are reasonable and response is quick.

Are there any risk factors involved in changging the job by invoking AC21 ??
its not any more or less risker than someone who is not married or whose spouse has already filed 485 (ie. your special case makes no difference to your using AC-21): only thing to consider is: what visa is your wife on, if H4, then you must change jobs using H1. You will need to stay on H1 until your PD is current and your wife is able to file her 485.

Sorry for posting this in an Immigration forum. I am just trying to get some advise from people who might have already been in this situation.
My cousin came to US on F-1 visa in Jan 2007. She has been attending grad school in NY...She got money from India to pay for her tuition for the first semester as she had no financial aid....One professor promised her aid starting Aug 2007 but that prof left the university for personal reasons so I paid her tuition/insurance for one semester ($10k)....I have also been helping her with her living expenses since she arrived in US....She only worked 1 day throughout the year and has a W-2 with $29 as earnings for 2007...
My question is, can I claim her as a dependent in my tax filing....She lives in NY and I work/live in TX.....I am planning to consult a tax professional regarding this, but I just wanted to get a heads up from you all before visiting a professional.

The illegal immigration is a very complex subject. Who , what how created illegal immigration would be a matter of debate.
This organization does not have a stated position on illegal immigration. The american people have to go through their own process to deal with that.
This organization's goal is to concentrate on the High skilled immigration and the delays associated with high skilled immigration. We have limited resources and we have to maintain the narrow focus and not get lost in the larger picture..
I hope this brings this discussion to close..I consider it closed...

Guys,
My wife was working on H1B now and she got EAD last week. Out of the following options which is TRUE and which is BETTER.
Option 1--> Moving to EAD from H1B by signing on I-9
Option 2--> COS from H1 to H4 and then to EAD.
I read in some of our threads that if we choose option 1 and if something goes wrong in AOS, we have to file for new H1B again. We have to wait for quota etc etc.
I also read that if we choose Option 2, if something goes wrong in EAD, we can always change back [ie RESUME]to H1B.
I am not so sure about these. Could some one share their thought.

I was laid off from company A in MAY 2002 (got salary till 31st May), later joined company B from 1st July 2002, so, I think, I was �out of status� for 1 month, later left company B because of differences on 31st October 2002 (received salary till 31st Oct ) and filed for H1 transfer with other company C on 11th November 2002, I got H1 approval on March 10th 2003, and started working with company C from April 2003 till now, so have 5 months gap between company B and C.
Was I out of status? If yes, looks like I was out out status for 6 months (5months continues plus 1 month earlier), unfortunately this comes to 181 days (june, nov,dec,jan,feb,march).
My I-94 was never expired and I went to India in Feb 2007 and got H1B stamping done and entered US with no problem.
I started my labor with current employer in May 2004 and got I40 approved as well, now filed for 485 in july rush, got EAD and fingerprinting notice, I am worried that my 485 may be denied because of �out of status� in past.
My Question:
1.Was I technically out of status and unlawfully present?
2.How does 180 days calculated? (continues 180 days or 180 days added in two time span like mine)?
3.If there was any out of status or unlawful present in past, Is it erased after lawful entry in US (I did enter in US this year after H1 stamping in India)?
4.Is Fingerprinting notice assures that everything is fine except security and criminal check?
Please help? I am really tensed after reading few forum, This will be horrible emotional set back for me and my family after 6 years in waiting if our 485 is rejected.

Is it possible to change to Consular processing while I-140 and I-485 is in pending.
I filed 485 in Aug and do not have the receipt either.
Kindly advice.

If PERM is pending for over a year, then the new employer can apply for H1 extension for 1 year. This whole PERM process will have to re-started with the new employer.

We went for FP today and my wife had henna on her hands. I was concerned about it but it never was an issue. The FP went as if she had nothing on her hands instead the FP people pleasently talked abt henna.
We went to the Atlanta office, the staff was pleasent, work flow streamlined and we were done in less than an hour although they looked and checked our hands almost four times for bandages and cuts.
